Darby man charged with felony DUI

A Darby man pulled over for speeding on Hamilton’s Grantsdale Lane Friday has been charged with felony DUI.

Robert Scott Brown, 59, appeared Monday before Ravalli County Justice Jennifer Ray on the felony charge and a misdemeanor count of speeding.

Brown was pulled over at 6:14 p.m. near the intersection of Grantsdale and Grundy lanes for driving 50 mph in a 35 mph zone, according to the charging affidavit.

After noticing a strong odor of alcoholic drink and seeing Brown’s movements were slow and deliberate, the arresting officer asked Brown if he had been drinking. Brown admitted to drinking three beers a couple of hours earlier, the affidavit said.

The affidavit said Brown performed poorly on the field sobriety test, the affidavit said. A breath sample at the detention center resulted in a .141 breath alcohol content. In Montana, a driver is considered impaired at .08.

Brown has prior DUI convictions in Massachusetts in 1981, 1985, 1992 and 1996.

Ray set bond at $10,000.
