A Darby man is charged with attempted deliberate homicide after allegedly discharging a pistol during an altercation outside a Conner bar Sunday night.
Thomas Daniel Burkhart, 49, appeared Monday before Ravalli County Justice Jim Bailey on the felony charge and misdemeanor counts of assault and disorderly conduct.
Burkhart was drinking at the Two Rivers Bar when he allegedly made a comment regarding another man’s girlfriend and an argument ensued, according to charging documents.
At that point, another man walked up to the two men who were arguing and for reasons that remain unclear, Burkhart punched that man in the face and knocked him unconscious. A female bartender stepped forward, broke up the disturbance and sent Burkhart outside.
A short time later, the woman whom Burkhart had disparaged earlier followed Burkhart outside and a new altercation ensued. The woman’s boyfriend stepped outdoors to find Burkhart throwing punches at the woman and holding her up against the building, the affidavit said.
At that point, the woman’s boyfriend intervened and took Burkhart to the ground.
The man told an officer later that while he was attempting to restrain the man, Burkhart told him: “I have a gun and I’ll kill ya,” the affidavit said.
A struggle ensued over the handgun. As the man pushed the handgun away from his face, Burkhart allegedly fired the .45 caliber Glock. The man reported the bullet from Burkhart’s pistol passed by his head.
At that point, several other people stepped in, took the handgun from Burkhart and separated the two men.
When a sheriff’s deputy seized the handgun he found that it had a spent cartridge jammed in the slide, which indicated the slide was likely being held open by the other man when the trigger was pulled.
Bailey set bond at $25,000.

Loni Renea Hammons, 39, of Corvallis, was charged with two counts of felony possession of dangerous drugs and a misdemeanor count of possession of drug paraphernalia.
Hammons was arrested Aug. 1 following a traffic stop in Victor.
The arresting officer found methamphetamine and dextroamphetamine in Hammons’ possession, the affidavit said.
Bailey set bail at $20,000.
